1. TRIAL PERIOD INSTRUMENT RENTAL
The trial period is for 1 month beginning on the 1st of the month and ending on the final day of the 1st month of instrumental rental. After the last day of the 1st month the month to month instrumental fees begin on the 1st day of the 2nd month of instrumental rental.

2. RENTAL OWNERSHIP and MANUFACTURER’S WARRANTY
The Total Cost of Rental does not include other charges, including but not limited to, the optional Liability Damage Plan, late fees or applicable taxes. You will not own the instrument until you have paid the total amount necessary for ownership. There
is also an early purchase option. There is a 1 year warranty from The Music Academy of Virginia, LLC after the purchase of the instrument.

3. LIABILITY DAMAGE PLAN (LDP)
If you choose to purchase the LDP fee and are not in default of this agreement, you will not be liable for loss of or damage to the instrument due to theft or fire. For Theft, you must provide us with a Police report displaying forced entry within 72 hours of the loss. The LDP does not cover mysterious disappearances. We will not replace the instrument and payments made prior to the date of loss or damage. If you claim a loss under the LDP you agree that we are subrogated to all of your rights, claims, and remedies due to the loss of the instrument including but in no way limited to your rights or any recoveries under any insurance policies. LDP covers some repairs at no charge unless damage is due to the user’s willful act or negligence, in which case our standard repair rates will apply. The LDP does not include damage to strings, bridges and tuning pegs. ALL REPAIRS MUST BE DONE BY A COMPANY APPROVED TECHNICIAN. You can only add the LDP during the initiation of this agreement. You CANNOT add it later. The LDP is void if payments are past due.

4. EARLY PURCHASE OPTION
At any time you can purchase the instrument by paying the Total Cost of Rental less the Cost of Rental Service less the total of payments made, times 75% (25% discount), plus any applicable sales tax. LDP fees do not apply toward the early purchase option.

5. OTHER FEES
Late Fee: $10.00 on payments not received within 10 days of the due date.
Return Check Fee: $25.00

6. DEFAULT
If you fail to make a rental payment within 10 days of the due date, or fail to observe any other term in this Agreement, you are in default and this agreement will be terminated. If you default, you must pay us for all of our reasonable costs of collection which may include some or all of the following: $50.00 repossession fee, a 30% third party debt collection fee, late invoice fees and a $15 third party administrative collection fee plus any other court costs and/or legal fees, as permitted by law. These amounts are in addition to the underlying balance due. During a default, any rental credit earned is void, and you are liable for amounts due us and immediate return of the instrument. If you are in default, The Music Academy of Virginia, LLC reserves the right to report your credit and payment history to any of the credit reporting agencies at our option.

7. MAINTENANCE AND REPAIR
If you do not choose the LDP option, you will be responsible for maintaining the instrument in good working condition during
this agreement.
